How Texas Workers Compensation Benefits are paid

Temporary Benefits

Max is 401 weeks total

Lifetime Benefits

Death Benefits

Paid to Beneficiary

1 st benefit is Temporary Income Benefits (TIBS)

Max time is 104 weeks

Paid 70% of AWW unless pay is $8.50 an hour or less, then you get 75% for the first 26 weeks

Paid weekly

Must be a permanent disability Paid 75% of AWW for life

Beneficiaries get 75% of employee’s AWW

Paid weekly

2nd benefit is Impairment Income Benefits (IIBS)

Benefit calculated at 3 weeks for each % of impairment

Paid at 70% of AWW

You can commute* your benefits at this level

You must suffer the

LOSS OF:
Two hands, Two eyes, Two feet, A hand and a foot, A spinal injury, or A head injury

$6,000 Burial Benefit

Death Benefits payable to dependent children or widow/widower

Kids get it until 18 or 25 if they are in school

3 rd benefit is Supplemental Income Benefits (SIBS)

Must be at least 15% disabled to get to this level and have to try to find a job you can do

Benefit is paid for the life of the employee. If the employee dies, no more benefit.

Benefit is paid for her life or until she remarries. Then the benefit is commuted* for 104 weeks

*Commute means paid in one lump sum

 After 401 weeks of Temporary Disability, you are out of time and out of money

Permanent disability have no time limit

Lifetime of injured employee

Death benefits has no time limit unless widow remarries

(kids to 18 or 25 if going to school)
